SEMINAR: ART: CHALLENGING THE LIMITS OF LEGALITY 3/8/2021 al 24/8/2021

The purpose of this seminar is to answer several questions that currently exist related to cultural goods or works of art and the law in the face of a greater circulation of works of great value in the international market. The traffic of cultural goods and cultural heritage goods, the works’ new materialities and their commercialization, the incorporation of new marketing platforms such as blockchain, are some of the challenges the seminar intends to address.

Coordinator and Moderator: Dr. Mauricio de Nuñez. Lawyer graduated at the Faculty of Law and Social Sciences of the University of Buenos Aires (1980). Former Secretary of Justice in Criminal Matters of Investigation, advisor to companies, to diplomatic and consular representations, and to the National University of Tres de Febrero.

TUESDAY, AUGUST 3. Hours: 15 to 17.

The principles of protection of plastic works by copyright.

Federico A. Villalba Díaz. Lawyer (UBA). First Instance Prosecutor before the Criminal Jurisdiction of the City of Buenos Aires. Master in Law. Professor in the Master of Intellectual Property at the Austral University. Expert Speaker of the World Intellectual Property Organization (WIPO).

News in the market of works of art.

José Miguel Puccinelli Lawyer. Partner of the Beccar Varela Studio. Professor at ESEADE (Curatorship III - Art and Law) since 2007. Master's degree in Business Law at the University of Angers (France). Postgraduate in Private International Law at the University of Pantheon Assas (Paris II).

TUESDAY, AUGUST 10. Hours: 15 to 17.

Cultural and heritage goods; legal system of their traffic in Argentina: permitted, conditioned or prohibited.

Pablo Luis Gasipi. Fiscal Assistant, Federal Criminal and Correctional Justice of the Federal Capital; lawyer specialized in criminal law (USAL, 1998; PhD student, 2015), in environmental law (UCA, 2003) and in the fight against organized crime (USI, 2018); lecturer, professor and university researcher (2003-present).

The system of prevention and repression of money laundering and its goal: to destructure criminal activity by economic means. The specific regulations on the activity of the works of art’s market in Argentina.

Agustín Luis Biancardi (Lawyer, UBA, 1995), former Judicial Officer, Legal Advisor at the Ciudad Bank, former Director of Criminal Litigation of the Argentine Financial Information Unit (2016-2020). Specialist in economic crimes and money laundering.

The traces of artistic creation.

Dr. Gabriela Siracusano. PhD in Theory and History of Art, UBA. Main Researcher at CONICET, Regular Professor at UBA. She is Director of the MATERIA Center (IIAC-UNTREF). Specialist in the study of the images’ material dimension.

Dr. Marta Maier. PhD in Chemistry at the Faculty of Exact and Natural Sciences of the University of Buenos Aires. She is a Main Researcher at CONICET and Associate Professor of the Department of Chemistry at UBA. Her line of research includes the study of materials in art and archaeology and their degradation reactions.

The role of the Argentine Federal Police and Interpol in the fight against illicit trafficking in cultural property.

Commissioner Marcelo El Haibe. He joined the Argentine Federal Police in 1984. He currently holds the rank of Senior Commissioner and is the Head of the General Directorate of International Coordination, on which the Interpol Department and the Department for the Protection of Cultural Heritage report. He is a Permanent Member of the Argentine Committee to Combat Illicit Trafficking in Cultural Property. Expert consultant for UNESCO in 2015 on the Measures to be Adopted to Prohibit and Prevent the Illicit Import, Export and Transfer of Ownership of Cultural Property.

TUESDAY, AUGUST 24. Hours: 15 to 17.

New systems of identification, verification, registration and certification via Blockchain. How the tokenization of works verified by third parties can be the solution to the art market’s old problems.

Gustavo Perino. Degree in Expert Reports of Works of Art. Professor and Coordinator of postgraduate studies in Art Expertise at the Santa Úrsula University in Rio de Janeiro. Member of ICOM Brazil and the Institute of Valuation and Authentication of Works of Art-i3A. Founder and director of Givoa Art Consulting (Brazil and Argentina)

Gabriel Mucchiut.  Partner Lawyer at Revilla Cornejo & Gutiérrez Braun. Specialist in Blockchain & Law. CEO of Emyto Escrow Service. Co-founder of Tokenizart. IOT + NFT. Traceability of art.

 

Duration: Four (4) classes of 2 hours each.         

Platform: Zoom I Period: Tuesdays 3, 10, 17 and 24 August from 15.00 to 17.00 (Argentine Time)

Value – Full course: $4,000 (four thousand Argentine pesos) for residents in Argentina, U$D 60 (sixty U.S. dollars) for residents abroad.

The cancellation of the total amount in a single payment will be a requirement for the start of the course. Payments in Argentina can be done through bank transfer, deposit, credit card or Mercado Pago. From other countries, via credit card or PayPal.

Includes certificate of attendance.

Class attendance will have an audiovisual format, through a single private link that will be sent by email to the students enrolled from the day of the start of the course, and during the next lessons. Each class will be available online for 7 calendar days. After this time, the material will be taken off from the digital platform.
